Attorney General Merrick Garland appointed a special counsel to investigate why President Biden had classified documents from the Obama administration in his private office and at his home in Delaware.
The Department of Justice, headed by Attorney General Merrick Garland, moved relatively fast and appointed Special Counsel attorney Robert Hur to investigate Biden’s handling of the documents.

Robert Hur is a Trump appointee who served as the US attorney for Maryland. The Senate unanimously confirmed him in 2018. Hur oversaw corruption cases into Maryland public officials, including state legislators.

While Trump appointed Hur, some conservatives have already expressed skepticism that he will be impartial as he was the assistant to FBI Director Christopher Wray.

Biden Press Secretary Karine Jean-Pierre emphasized that the Biden administration was not aware that Garland was going to carry to appoint Special Counsel to investigate the documents debacle.
“We were not given a heads up, and we learned from the press conference,” Jean-Pierre said in the briefing.
Biden was reportedly attending a funeral when news of the Special Counsel appointment broke, something that reporters pressed Pierre on: “Look, he was at a funeral, to your point. Maybe one of his senior advisers may have told him. I actually don’t know specifically when he knew, but what I can say to you, he was, we were not given a heads-up. That I can confirm.”
The scandal is particularly embarrassing for Biden as the Department of Justice mulls charges against Trump for allegedly mishandling classified documents stored at his Mar-a-Lago estate.

Pierre said that Biden has cooperated with the Department of Justice “fully” so far, though she refused to confirm that there were no more classified documents in other locations.
“Look, as the lawyers said, we have been working closely with the Department of Justice and coordinating a search that was still ongoing to ensure any additional documents were in the proper possession of the government,” Jean-Pierre told reporters Thursday.
“After that search, after the search concluded last night, we released a statement disclosing the facts from that search, as you all know, this morning. This is all part of the Justice Department process, and you heard the attorney general speak to this today, so we are being very careful to be fully cooperative with the Department of Justice and providing details as appropriate as part of that process.”
Asked if Biden is confident that no more classified documents will come to light, Jean-Pierre replies: "I can just refer you to what his team said. The search is complete."
