Top Dems Say They Might Not Certify a Trump Victory

3Some Democratic lawmakers, including former January 6 committee member Jamie Raskin (D-MD), have stated they will not commit to certifying the 2024 election if Donald Trump wins. Raskin, who voted against certifying Trump’s electors in 2017, is among the many Democrats who accuse Trump of undermining American democracy. Nevertheless, he and two other high-ranking colleagues suggested in a Thursday Axios report that they might attempt to block a Trump victory.

Raskin reportedly told the outlet that if Trump “won a free, fair, and honest election, then we would obviously accept it.” However, Raskin also claimed that there is “definitely” a chance that Trump will steal the 2024 election and that he is prepared to vote against certification.

“[Trump] is doing whatever he can to try to interfere with the process, whether we’re talking about manipulating electoral college counts in Nebraska or manipulating the vote count in Georgia or imposing other kinds of impediments,” Raskin said.

The Maryland Democrat, who currently serves as House Oversight Committee ranking member, has repeatedly made headlines this year for making action plans to legally prevent Trump from taking office.

During a February book talk in Washington, D.C., Raskin suggested that if the Supreme Court does not block a Trump presidency, it would fall to Congress to disqualify him under “Civil War conditions.”

[I]t’s going to be up to us on January 6, 2025 to tell the rampaging Trump mobs that he’s disqualified and we need bodyguards for everybody in civil war conditions all because the nine justices – not all of them — but these justices who have not many cases to look at every year, not that much work to do – a huge staff, great protection, simply do not want to do their job and interpret what the great 14th Amendment means,” Raskin said.

During the same month, his office posted to Facebook that “Disqualifying Trump from office under Section III of the 14th Amendment doesn’t undermine democracy–insurrection does that.”

Additionally, in August 2023, Raskin appeared on CNN to claim that the 14th Amendment shows a “clear and unequivocal statement” on Trump’s “disqualification.”

Some of Raskin’s colleagues also questioned whether they would certify a Trump victory in the Axios report Thursday. Rep. Jan Schakowsky (D-IL), a House senior chief deputy whip who voted against certifying President George Bush’s 2004 victory, said she would need to “make sure that all the rules have been followed.”

“I don’t know what kind of shenanigans he is planning,” she said, referring to Trump.

House Rules Committee Ranking Member Jim McGovern (D-MA), who voted with Raskin against certifying the 2016 election, said his “expectation is that we would” certify. However, he also said he would “have to see how it all happens.”

Following the 2016 election, Democrats consistently objected to the legitimacy of Trump’s win. During his 2017 inauguration, 67 Democratic lawmakers boycotted the event, claiming the election had been stolen.
