Kamala Backs Push to ‘Delegitimize’ SCOTUS
Presumptive Democratic nominee Kamala Harris on Monday endorsed a plan to “reform” the U.S. Supreme Court, including the adoption of term limits and a “code of conduct” for justices. The proposal, delivered jointly with President Joe Biden, was unveiled during an event commemorating the 60th anniversary of the Civil Rights Act.
Vice President Harris outlined her support in an official campaign statement, writing that there is “a clear crisis of confidence facing the U.S. Supreme Court.”
“In the course of our Nation’s history, trust in the Supreme Court of the United States has been critical to achieving equal justice under law,” Harris said. “President Biden and I strongly believe that the American people must have confidence in the Supreme Court. Yet today, there is a clear crisis of confidence facing the Supreme Court as its fairness has been called into question after numerous ethics scandals and decision after decision overturning long-standing precedent.” ~ Kamala Harris
Biden also detailed the plan in a Washington Post op-ed. The proposed reforms include term limits of 18 years for justices and a code of conduct requiring them to “refrain from political activity.” The reforms would also limit the ability of Presidents to fill vacancies on the Court to once every two years.
The proposal also calls for rolling back Presidential immunity, guaranteeing prosecutors the ability to charge former Presidents for alleged crimes committed while in office.

The President also urged Congress to adopt the measures in his op-ed.
“I served as a U.S. senator for 36 years, including as chairman and ranking member of the Judiciary Committee,” Biden wrote, touting his many decades in office. “I have overseen more Supreme Court nominations as a senator, vice president, and president than anyone living today.”
Biden has repeatedly proposed reforming the U.S. Supreme Court. Three years ago, he launched a commission to study the possibility of structural changes to the court, including term limits and court packing.
Harris, however, reportedly played a much larger role in creating this latest proposal. On Monday, White House press secretary Karine Jean-Pierre told reporters that Harris was personally involved in drafting the new reforms.
“The president consulted her closely,” Jean-Pierre said Monday. “Let’s not forget that she was a former member of the Senate Judiciary Committee, as well as a former attorney general, so he certainly listened to her expertise in this arena.”

With Biden exiting the 2024 Presidential race on Jun. 21, Harris has recently stepped in as Democrats’ top pick for the next White House administration. Her decision to reform the Supreme Court, an item of her campaign, drew immense backlash from Republicans.
U.S. House Speaker Mike Johnson (R-LA) issued a statement rejecting the reforms, calling them “dead on arrival.”
“Biden’s proposal to radically overhaul the U.S. Supreme Court would tilt the balance of power and erode not only the rule of law, but the American people’s faith in our system of justice,” Johnson said in a post on X. “This proposal is the logical conclusion to the Biden-Harris Administration and Congressional Democrats’ ongoing efforts to delegitimize the Supreme Court.”
