Dayne Victor Miller, 44, of Cape Coral, was arrested this week when he allegedly found his naked roommate sleeping in his daughter’s bedroom and fired a few rounds at him through his bedroom door.
On March 8, 2023, at approximately 12:32 a.m., officers from the Cape Coral Police Department responded to 1041 SW 1st Street, Cape Coral, Lee County, Florida, about a shooting.

Miller called 911 and said that one of his roommates was naked in his teenage daughter’s bedroom, which caused him to shoot at both roommates through their closed bedroom door.
Upon arrival, officers secured the scene and removed the couple from their bedroom. Officers learned that the two victims were a married couple renting a bedroom in Miller’s home. Also living in the house were Miller’s wife and teenage daughter.
Officers contacted Miller, who cooperated with officers and exited the residence, where he was quickly secured. Officers observed shell casings and bullet holes through the victim’s bedroom door.
The male victim acknowledged drinking too much earlier that evening and said he got up to use the restroom. When he was finished, he mistakenly went into the bedroom of the teenage female who lives at that location, who was asleep in bed. The victim lay down beside the teenager and fell asleep. Once the teenager realized a naked male was sleeping next to her, she went to Miller to let him know that a naked man was in her bed; she did not allege a crime had occurred against her.

Police say the naked man’s spouse woke him up and “shouted that the room the victim was in was not their shared room.” The naked man got up and went to his room with his wife.
“Once the victims returned to their room, Mr. Miller approached their bedroom and began pounding on the door shouting, ‘I’ll kill you,’ after the door was shut and locked on him.” “That is when Mr. Miller shot his handgun 3-4 times into the floor outside the bedroom door in a rage.”
Miller was transported to the Lee County jail and charged with two counts of aggravated assault with a deadly weapon and one count of shooting into an occupied dwelling. He is being held without bond currently.

Miller is scheduled to appear in court on April 10 for his arraignment.
