As Senate Democrats have ratcheted up pressure on conservative Supreme Court Justices over alleged ethics concerns, Senator Ted Cruz, R-Tx. pushed back against them on a Sunday interview with Maria Bartiromo.
Cruz pointed out that other justices, including liberal justices such as Stephen Breyer, Ruth Bader Ginsburg, and Sotomayor, have also taken foreign trips funded by outside groups. The Senator said that Thomas is being targeted because he is a black conservative and a staunch constitutionalist, calling him “one of the greatest Supreme Court justices ever to serve on the court.”
“Democrats hate Justice Thomas, and they save this special degree of hate for him, because he’s a Black man,” Cruz declared. “And their view is an African American is not allowed to be a conservative, is not allowed to disagree with Left-wing orthodoxy.” He said.

Cruz further said that Democrats see Thomas “as a traitor because he is African-American,” to which Bartiromo replied, “How disgusting!”
“This is a political smear job directed at Clarence Thomas because he is an extraordinary constitutionalist, and the Left hates him for it,” Cruz pointed out. Bartiromo concurred, saying that it was “more of the same.”

Republican lawmakers are not the only people who oppose Democrats’ aggressive attempts to constrain Supreme Court Justices and impose tighter ethical mandates on them.
In a rare show of unity, all nine Supreme Court Justices signed a statement opposing the attempt.
“This statement aims to provide new clarity to the bar and to the public on how justices address certain recurring issues,” all nine justices wrote in a signed statement, “and also seeks to dispel some common misconceptions.”

They further said that Congress attempting to legislate strict requirements for justices to recuse themselves could result in politically slanted decisions.
“If the full Court or any subset of the Court were to review the recusal decisions of individual justices,” they wrote, “it would create an undesirable situation in which the Court could affect the outcome of a case by selecting who among its members may participate.”
Legal watchdog groups have expressed concerns that Democrats are attempting to do precisely this while undermining the courts’ credibility because of its conservative majority.

“It’s no surprise that the justices who are being targeted by these stories are all on one side of the ideological spectrum because it’s not that there aren’t other justices who have wealthy friends,” said Carrie Severino, a former Thomas clerk and president of JCN, a conservative legal group.
Severino further said that the recent effort by Senate Democrats is an attempt to ‘intimidate the court’ after Democrats’ agenda has been set back with the repeal of Roe v. Wade and other key decisions.
“It’s very clear [all the justices] recognize what’s going on. That’s why they signed this statement. This isn’t about the ethics code because they’ve got one,” Severino contended. “This is about intimidating certain members of the court, and they all can get behind exactly what the proper guidelines are.”
