San Fran DA Drops Charges on Crowbar Attacker, Charges Victim for Self-Defense
San Francisco ex-fire commissioner Don Carmignani says the city is “burning” after the District Attorney dropped charges against a vagrant who repeatedly bashed him in the head with a metal crowbar. Now, Carmignani is facing charges for defending himself with pepper spray.
53-year-old Carmignani was left fighting for his life after being brutally attacked with a crowbar on April 12 by homeless man Garrett Doty. The former fire commissioner saved himself by pepper spraying his attacker outside his mother’s home in the Marina District. Carmignani was left with a fractured skull and jaw from the attack and required 51 stitches after Doty allegedly beat him over the head.
In an interview with KPIX, Carmignani explained that, aside from the physical damage, he now suffers from severe night terrors and short-term memory loss due to his injuries.
Video evidence of Doty preparing for the attack was later obtained. According to the New York Post, Doty, who was on Carmignami’s mother’s property, could be seen on video yanking the crowbar out of a trashcan and even taking a few practice swings.

When Doty refused to leave the premises and became threatening, Carmignami pepper sprayed him. The Post reported Carmignani took matters into his own hands after the city neglected his mother’s 911 calls asking for help removing people from her property after witnessing a trio consuming drugs and harassing neighbors in her entryway. Cargimani told KPIX he saw men “smoking crack cocaine” while leaning against his elderly mother’s door the morning of the attack.
Doty then proceeded to attack Carmignami with the weapon.
Doty was initially charged with assault with a deadly weapon, aggravated battery with serious bodily injury, and assault with force likely to produce great bodily injury. However, he was released back to the city streets without charges after prosecutors pointed to Carmignani as the aggressor.
A source told the New York Post that the decision comes partially due to maintaining political narratives.
“We live in a city where both the mayor and the DA are elected. Their re-election is very much tied to public perception of crime and safety. Therefore, they have a vested interest in changing the narrative to make it appear that crime is not random. The city should stop politicizing public safety and instead focus on doing their job of making San Francisco a safe and livable city for everyone,”

The source even told The Post that the San Francisco Police Department and DA’s office both failed to interview Carmignani about his version of events before deciding to drop the charges on Doty.
“My daughter and her friends carry spray; what if it was one of them when you have animals in the street saying they are going to rape your daughter and kill your mother and you have nothing to do or help?” Cargimani told KPIX.
