Gallagher, a California licensed attorney, is a well-known outspoken critic of developers and even filed a lawsuit to stop a development project near her residence. She was one of six candidates for the Surfside Town Commission last year, finishing in sixth place in the election held just six days before the alleged murder occurred.

According to court documents, just four days before her uncle Thomas Burke died, he signed a new last will, changing his intentions and making Gallagher the sole beneficiary of his estate. The new will states that under no circumstances should anything go to his daughter, two sons, grandson, or ex-wife.

The grand jury indictment issued December 8, 2022, was sealed, but the Broward Clerk of Court indicated an existing warrant from the Fort Lauderdale Police Department for Gallagher’s arrest on a murder charge dating back to March 21, 2022,
During a video court appearance, her lawyers asked for Gallagher to be able to see a doctor after she was involved in an accident while being transported to jail and claimed she was in severe pain. Gallagher told the judge she was in the Chicago area on Thursday and was taken into custody Friday, charged with premeditated first-degree murder with a firearm. The charging document or “information” could be unsealed as soon as Tuesday.
Gallagher’s attorney declined to speak on the case, saying the indictment remains sealed.
