The murder charge stems from an incident that occurred in the 900 block of vine street in Daytona Beach. Gibbs claimed that he was cut of by a motorcycle driven by the victim Tomas Lee Bouknight. Gibbs waited a few moments and completed his turn only to find Bouknight standing in the middle of the street waiting for him. Gibbs claimed that as he passed him, the victim started shooting at his car. That’s when Gibbs pulled out his pistol and shot back. Gibbs then pulled into a church parking lot and called police.

Daytona Beach Police say Gibbs’ version of events does not match up with witness statements, video, or forensic evidence. Witnesses stated that Gibbs drove past Bouknight and then the two were in a verbal argument on Vine St. Gibbs then allegedly pulled out a gun and started shooting. Bouknight then pulled out his own pistol to defend himself. Bouknight fell to the ground and Gibbs then pulled his vehicle up a few feet, exited his car, and shot at Bouknight over the hood. Gibbs then pulled into a church parking lot and called police.

When detectives confronted Gibbs about the witness statements and video, he did not have further comment.

Gibbs was originally charged with attempted murder and booked into the Volusia County jail with a $75,000 bond. When Bouknight died of his wounds, Gibbs was charged with murder and his bond was changed to no bond
