Florida Councilman Busted for DUI-Police Find Ten Grams of Cocaine Hidden in His Shoe

Palm Bay Councilman Peter Joseph Filiberto, 34, of Surfside, spent the night at Sheriff Wayne Ivey’s luxurious Green Roof Inn, aka the Brevard County Jail, after he was arrested for driving under the influence after fleeing a traffic stop.

But wait, there’s more. Filiberto was also charged with refusal to submit to a breathalyzer test, driving while license suspended with knowledge, reckless driving, and no motorcycle endorsement. Then, to top it all off, after being transported to the Brevard county jail, corrections deputies found 10 grams of cocaine in his shoe during a prisoner search.

Palm Bay police spotted Palm Bay city councilman Peter Filiberto late Saturday night on his motorcycle driving down Lipscomb Street speeding through a residential neighborhood at well over the limit, driving recklessly, and running stop signs.

Palm Bay police said an officer initiated a traffic stop on Filiberto near Huckleberry and Lipscomb streets. The officer then turned around and saw Filiberto ride his motorcycle into the Palm Bay Colony neighborhood. Filiberto decided to try and dip on the officer.

Filiberto sped away from his third DUI arrest and attempted to make a U-turn to flee from the officer but lost control and dumped his bike, arrest reports show. The officer pulled up and noticed the smell of alcohol on Filiberto’s breath and then placed him into custody.

Filiberto declined to speak to the police officer and refused to take a breath test before being taken into custody. Filiberto was transported to the Brevard County jail. He was charged with cocaine possession, reckless driving, driving under the influence of alcohol, refusing a breath test, driving while license suspended with knowledge, and driving without a motorcycle endorsement.

While in a holding cell, detention deputies began to search him and told Filiberto to take off his shoes. Deputies found 10.6 grams of cocaine hidden inside one of his socks.

His bond was set at $9,000, and he was released the next morning around 10:30 a.m. after making a first appearance in front of the judge and posting the bond. His next court date has not been set at this time.

Filiberto is a Surfside resident (why is he a Brevard County councilman when he lives in Dade County) who was elected just last year.

Court records show that Filiberto had previous arrests for DUI in 2008 and 2019.

Filiberto is a contractor with the Department of Veteran Affairs and the vice chairman of the Brevard County Planning and Zoning Board. He is also the son of the former Palm Bay Mayor, Frank Filiberto.
