Dershowitz on ‘Absurd’ Trump Charges: Lincoln or Jesus Couldn’t Get Him Acquitted
Legal expert Alan Dershowitz is sounding the alarm over Donald Trump’s upcoming trial in Manhattan, warning that Democrats will likely deny the former president a fair process, even if it means they must “stretch the Constitution.” While Dershowitz asserted that the case against Trump is “absurd,” he argued on Deutsche Welle’s Combat Zone this week that an acquittal may be impossible to secure in deep blue New York City. With roughly 87 percent of Manhattan voting against Trump in 2020, the star attorney says that even Jesus could not persuade the jury.
Dershowitz is a former Harvard law professor who defended Trump during his first impeachment trial. He spoke to Deutsche Welle reporter Tim Sebastian this week to pick apart the “selective prosecution” brought by Manhattan District Attorney Alvin Bragg.
“What [Bragg] is basically saying is when somebody pays hush money to prevent an allegation of an adulterous affair from being made public… He must immediately put the exact reason why he paid that money in a corporate public form.
Nobody in history has ever done that. Nobody in history will ever do that. It’s an absurd charge. It’s selective prosecution… I don’t want to see the criminal law stretch the Constitution contracted in order to get Trump.”
Dershowitz added that it was a “very grave danger” since Trump “is an easy person to go after because he has so many flaws and fallacies” and accused Democrats of blurring the line between voting against someone and “prosecuting them for a non-crime.”
“I want to maintain that line very strongly,” he said.

Dershowitz continued, saying that partisan prosecutor Alvin Bragg is at the heart of the trumped-up Trump charges.
“The name of my book, Get Trump, is not original with me. It comes from the campaign promises of the district attorney,” the legal expert said.
“It would be unthinkable in Germany, unthinkable in Great Britain, unthinkable in France, for a prosecutor to run for office–number one–and number two, promise in advance that he was going to get somebody and then rummage through the statutes to try to find something against him, and when he couldn’t find anything in the statute books, to create a crime.”
“The American criminal justice system, which I have been teaching about and practicing for 60 [years], is in great danger,” he added.

Despite previously securing an acquittal for Trump during his first trial, Dershowitz appeared short on optimism, saying that the overwhelmingly left-wing voter base of Manhattan might be too great of an obstacle to overcome.
“You can’t get a fair jury trial in Manhattan, where people voted for the district attorney on the promise that he would get Trump,” Dershowitz said.
“Now these same people are going to serve on juries, and they’re going to try to help the district attorney who they voted for get Trump. What is it? 87 percent of people in Manhattan voted against Trump? The case should be moved to a different area where it’s more like 50.”
He then painted a bleak picture of the upcoming trial, arguing that the best outcome the Former President could likely hope for is a hung jury.
“Abraham Lincoln, Daniel Webster, Jesus Christ and Mohammed could not get him an Acquittal in the city of New York. Maybe a hung jury. Possibly a hung jury, but you’re not going to get twelve jurors who will say, we are willing to be the person to let Donald Trump go free and become the next president to the United States.”
“There’s so much opposition to Trump in New York,” Dershowitz said.
